House Speaker Pantaleon Alvarez tells the CHR to get funds for the salaries of their employees from criminals.

Alvarez was asked by media what happens to the CHR employees should their move to defund the CHR become law, Alvarez said, “eh hingin nila sa kriminal yun gusto nila protektahan.”

Alvarez is unperturbed by the criticisms of the House’s decision to defund the CHR. “yung mga comments sa social media, e alam naman natin yung laro sa social media di ba? Hindi naman yan necessarily reflective nung totoong sentiments ng karamihan. “

Alvarez called a press conference with other House leaders on Friday where he defended the House’s decision to defund the CHR, reiterating that the budgets of the CHR, ERC and NCIP maybe realigned to government’s free college tuition program. “daming pwede paggamitan gaya ng libreng edukasyon”

Alvarez however is open to restoring parts of the CHR budget. “palagay ko masyado malaki yun”

Alvarez clarified he is not seeking Chairman Chito Gascon’s resignation. “wala naman di naman ako nagsasabing kailangan magresign siya eh kung magresign dapat lahat sila magresign  mali nga yung kanilang  ano tawga diyan pananaw sa tungkulin nila.”

Last Tuesday, CHR Commission Gwen Pimentel Gana revealed Alvarez wanted Gascon to leave before he approves the CHR’s budget.

However he slammed Gascon for staying in his job, “Yun na nga, sinasabi ko sobrang kapal naman ng mukha niya. Alam niyo kung sinasabi na ng karamihan na hindi niya ginagampanan yung trabaho niya, hindi niya ginagawa, eh dapat mahiya ka na eh. Hindi mo na ginagawa ang trabaho mo humihingi ka pa ng suweldo sa gobyerno? Hindi naman siguro tama yun.”

Alvarez however also said that the CHR should have commissionners who will uphold the mandate of the CHR which is to protect the human rights of all, state actors or otherwise. “dapat para  magalagay tayo ng commissioners na naiintidihan yung mandato nila kasi kung yung isip nila eh kaya sila andiyan para lang bantayan yung HRVs ng nasa gubeyrno mali yun dahil di ka nagbabasa ng provision ng cosntitution ang linaw linaw di lang dapat yung violationg ng isa gubyerno yun lang babantayan malianw kailangan pangalagaan protelktahan human rights ng lahat walang distinction

wala sa konstitusyon sinasbai nila basahin nila nasa saligang batas

yun dapat bibliya natin di kung ano sabuhin ng UN meron tayong saligang batas

gawin nila trabaho nila pero kungdi nila gawin trabaho nila sobrang kapal ng mukha gusto magpaswedo di ginagawa trabaho”

During his press conference, Alvarez and other House leaders berated the CHR and its supporters.

Alvarez told the CHR to be true to its mandate, as the House is only being true to its mandate to fix the budget. Alvarez says the CHR should be reminded of its mandate under the constitution.”Ayun na nga yung mali na they are trying to preach. Alam mo, kaya ko sinasabi na itong mga appointees ano, yung mga commissioners dyan sa CHR, including yung kanilang chairman, ay hindi nagbabasa ng Saligang Batas. Yun dapat ang bibliya nila. Basahin nila doon kung ano ang mandato nila. Malinaw na nakalagay doon na kailangan pangalagaan nila at protektahan ang karapatang pantao ng lahat. Hindi lang po ng kung ano lang ang gusto nilang protektahan. Hindi po puwedeng selective diyan.”

Alvarez said that while the CHR is a cosntitutional body, the House cannot abdicate scrutiny of its budget especially if they feel the CHR is not doing its job. Alvarez maintained that the CHR does not enjoy fiscal autonomy under the constitution. “ Ang gusto sana namin na gawin nila yung mandato nila base sa Saligang Batas. Kami binigyan ng poder ng ating Saligang Batas para umpisahan at ayusin yung budget, yung appropriations every year. Binibigyan nyan yung House of Representatives, hindi po yung Senado. Ngayon, ginagawa lang namin yung trabaho namin at tinitingnan namin kung ano ba ang ahensiya na gumagawa ng tungkulin nila base sa mandato ng Saligang Batas. Dahil kung hindi, ay hindi namin ginagawa yung trabaho namin, basta bibigyan lang namin sila ng budget dahil nakasulat sila, included sila dun sa enumeration ng ating Constitution. May mga nagsasabi na constitutional body sila. Tama yan, constitutional body. Pero hindi po tama na dahil constitutional body ka, yung CHR, ay pikit-mata na namin na basta bigyan namin sila ng budget. Eh kung hindi nila ginagawa ang tungkulin nila bakit namin sila bibigyan ng budget? At kung titingnan niyo at susuriin niyo mabuti yung provision ng constitution, tanging ang CHR lang ang walang fiscal autonomy. Lahat po ng mga constitutional commissions, including the Ombudsman, merong fiscal autonomy. Ang CHR lang ang wala.”

Alvarez wants the CHR to produce programs for victims of human rights violations. “Gawin nila yung trabaho nila. Ganun lang naman dahil, kaya namin ginawa yan na P1,000 dahil nakita namin di nila ginagawa yung trabaho nila. Simple lang, gawin nila yung trabaho nila at i-justify nila kung ano yung programam nila para doon sa mga innocent victims.””

Alvarez appeals to the CHR’s sense of shame,

asked exactly what does he think is the CHR doing, Alvarez replied that the CHR is merely protecting the human rights of its political allies, citing how Gascon only visited senator leila de lima but not other detainees. “Hindi ko alam. Nakaupo. Patawa-tawa. Inaalagaan yung mga karapatang pantao ng mga ano…siguro mga kakampi niya sa pulitika. Malinaw na malinaw naman yan. Dadalaw sa kulungan…ito, gusto niyo ng concrete example na namumulitika, ito ah. Dadalaw sa kulungan. Dinalaw si Sen. de Lima. Tinanong ko sino pa dinalaw mo dun. Wala na daw kasi wala na siyang oras. Alam mo kung dadalaw ka sa mga nabilanggo doon, nandodoon, ang lapit lapit naman nung selda nung iba. Eh bakit di man lang niya dinalaw at inalam yung kalagayan nung iba ding prisoners? Bakit isang tao lang? Pangalawa, anong ginawa niya nung Mamasapano case? Yung Mamasapano? May ginawa ba ang CHR under his leadership? Ayun malinaw na malinaw merong paglabag sa karapatang pantao, lalong lalo na yung mga isinubo doon sa kamatayan.”

Alvarez also pointed out that the CHR has not done anything for victims of the mamasapano massacre.

Alvarez says theyre open to retsoring the CHR’s budget during the bicameral conference committee proceedings but they have to justify it.

Alvarez also told the senate not to presume that the House will allow the Senate to restore the CHR’s budget.  Alvarez said the senate would be dreaming if they assumed that the senate will get its way. The matter can be discussed.””Alam mo, yung nga. Kagaya nung sinasabi sinabi nila sa gusto…wag naman yung kung ano yung gusto. Very presumptuous naman yan, na papayag kami na basta ganun na lang. Hindi po. Pag-uusapan natin at i-justify kung kailangan ba, kung ibalik, kung magkano, kung ano ang programa. Hindi po basta na kung sinabi nila na ibalik namin ng ganito. Eh nananaginip po tayo diyan.”

House Majority Leader Rodolfo Farinas also reminded the CHR of its mandate to uphold the human rights of all which is why the CHR’s statements that it is only here to police the state gives the perception that they are lawyering for criminals. farinas also said the CHR has to provide appropriate legal measures for the protection of human rights of all, adding that social democrats and leftists  who have led the CHR  appeared to have influenced the CHR into its current track.  Farinas also said the CHR has not presented any proposals for the compensation of human rights victims.

“Para lang madagdag ano, kasi po maliwanag sa Konstitusyon eh. Ito na po mismo yung probisyon sa Konstitusyon. Nakalagay po sa Contitution, the Commission on Human Rights shall have the following powers and functions. Number one po, unang-una, investigate on its own or on complaint by any party all forms of human rights violations involving civil and political rights. Kagaya ng sinasabi ni Joyce, sila ang sinasabi nila eh ‘we are here against state actions’. So ang kanilang emphasis lang, ang iniimbestigahan lang nila yung alleged human rights violations committed by the police and the military. Kaya tuloy ang perception itong human rights eh parang sila ang mga nagaabugado sa mga suspects o criminal. Pero like the Speaker said, Mamasapano, bakit hindi nila inimbestigahan? Pag nangkidnap yung NPA, pinupugutan ng Abu Sayaff yung mga tao. All forms of violations of human rights – kinikidnap po yung turista, patutubos mo tapos pag hindi natubos may mga reports nan a-rape, may report na pinatay. Nakita naman natin talaga – yung Canadian pinatay. You do not see the CHR going there to investigate. So kailangan mag re-orient naman sila para nakikita nga na sinusunod naman nila yung kanilang mandato sa constitution. Yung number 3 na duty nila – Provide appropriate legal protections for the protection of human rights of all persons within the Philippines. Lahat po ng tao hindi lang yung kung saan involved allegedly ang military o gobyerno duon lang. At iyon nga ang mali nila dahil siguro yung iba social democrats, yung iba leftist na naging chairperson dyan kaya maski yung orientation nila sinunod na ng buong commission na iyon na lang ang binabantayan na iyong gobyerno, hindi na tinitingnan yung iba.

Another is, one of its functions is to recommend to Congress effective measures to promote human rights and provide for compensations to victims of human rights or their families, violations of human rights. Yung Mamasapano wala ata kaming natanggap na report kung ano naman ang dapat na compensation na ibigay ng Kongreso o yung victims ng mass murder, yung mga ganun. Yung nangyari sa Maguindanao, hindi po ba violations of human rights iyon, hindi po yata kumpleto. So iyon ang aming tinitingnan ngayon, we want them to readjust also their focus and lived up to their constitutional mandate and abide by it. Kasi nga nanumpa sila na they will support and defend the constitution ngayon hindi po nila sinusunod.”
