Congress may now go ahead to create its own consultative body that will study proposed amendments to the 1987 constitution.
President Duterte already signed an executive order last December creating the constitutional commission but has yet to appoint members.
House Speaker Pantaleon Alvarez said, “tapos yun namang federalism, kasi nabinbin yung appointment noong mga supposedly commissioners para doon sa Constitutional Commission ano. Ang balak namin nag-usap kami ni SP kahapon ni Senate President, na puwede na naming i-convene yung Congress dito, Constituent Assembly, at saka kami na yung magtatalaga noong Constitutional Commission para magiging technical working group, para pag-aralan at gawin yung draft yung revised Constitution kung saan pinapalitan natin yung sistema ng goberyno to federal form of government”
Alvarez explains that once the commission has a draft constitution, that will be the one up for discussion by the Constituent Assembly. under the 1987 constitution, a constituent assembly is made up of senators and congressmen in their exercise of constituent power. Alvarez said, “pagkatapos niyan, pag tapos yung draft, pagdedebatehan ng Constituent Assembly at pagkatapos noon kung maapprove na sabay yung massive information drive upang sa ganoon ay maintindihan ng bawat mamamayang Pilipino kung ano yung revised Constitution na isasalang natin sa plebesito.”
Alvarez thinks the assembly maybe convened either January or February next year and this will work alongside the regular sessions of Congress. “so talagang maraming trabaho itong darating na taon.”
